Law Enforcement Co-operation Policy

For subscribers who joined before the 24th July 2005 this policy takes effect on the 1st August 2005. All other users are bound by this policy until is is superceeded.

At Sexybay we do not accept the sale of items that are illegal in their the buyer's or seller's location. As such we have established a policy for the co-operation with law enforcement agencies.

Should a law enforcement agency want details of a transaction (either in progress or completed), Sexybay has certain requirements before providing the information.

We require a written request on the organisations official letterhead. This request must include:

  • the department requesting the information,
  • the name, rank and identification number of the officer making the request,
  • the signature of the officer making the request,
  • a statement defining the person being investigated (a definition need only state "the buyer", "the seller" or "a bidder"),
  • the auction ID number,
  • a phone number to contact the requesting officer.

Upon receipt of a request, Sexybay will confirm that the requesting organisation has jurisdiction over the location of at least one person involved in the auction. Sexybay will the provide to the law enforcement organisation with the following information:

  • a copy of the auction listing,
  • identifying details for the seller, including:
    • full contact details from our database,
    • IP address and date/time of the auction listing.
  • bid history, including contact details for all bidders,
  • any other available information pertaining to the auction.

Once a request for information has been made by a law enforcment organisation, Sexybay will maintain a full log of all auction details and will maintain a record of these details for a period of no less than 12 months. During this time these details can be requested via the same process as above.

Should a law enforcement organisation request the revokation of an auction or a bid, and the person listing the auction or making the bid is within the organisations jurisdiction, Sexybay will action the request and contact the affected parties to inform them of the reason.
