Non-paying Bidder Policy

For subscribers who joined before the 24th July 2005 this policy takes effect on the 1st August 2005. All other users are bound by this policy until is is superceeded.
Overview
From time to time, sellers will encounter bidders who refuse to pay for an auction they have won. Sexybay views this as a serious
offence as it is contrary to the whole premise of purchasing an item on Sexybay.
What to do when you get a non-paying bidder
As a seller, if you encounter a non-paying bidder we encourage you to contact Sexybay. Non-paying bidder disputes can be lodged at
http://corporate.sexybay.com.au/enforce/npb. Simply make sure your dispute fits
within the following criteria and the fill-in the form at the URL above.
The criteria for filing a non-paying bidder dispute is as follows:
- The auction must have completed at least 7 days previously
- The auction must have completed not more than 28 days previously
- The seller must have made at least 3 attempts (at least 48 hours apart) to arrange payment from the buyer
If the previous criteria are fulfilled then a dispute may be lodged and Sexybay will follow up on the offence.
What does Sexybay do?
Upon receipt of a non-paying bidder dispute, Sexybay will attempt to contact the bidder. Sexybay will make 3 contact attempts via
email. These attempts will be 2 business days apart and will inform the user that they must respond within 7 business days of the
first contact.
If the bidder does not respond to Sexybay within this time, they will be penalised as a non-paying bidder.
If the bidder responds to Sexybay within this time Sexybay will attempt to resolve the issue. If the buyer agrees to continue the
purchase of the item, Sexybay will require that the transaction be completed within 7 days. Upon sending the money, the buyer must
notify Sexybay of the transaction details. This can be done via the form at
http://corporate.sexybay.com.au/enforce/npb/paid.html. Upon receipt of
the money the seller must also notify Sexybay. This can be done via the form at
http://corporate.sexybay.com.au/enforce/npb/recieved.html.
If the bidder does not agree to resolve the issue a penalty will be applied.
Dispute withdrawal
At any time the seller may withdraw the non-paying bidder dispute. This can be done at
http://corporate.sexybay.com.au/enforce/npb/withdraw.html.
Penalties
The penalties for a non-paying bidder are applied through the feedback system. A first offence causes 20 Sexybay Points to be removed
from the buyer’s account, and a reason of “Non-paying bidder – first offence” will be published on the
feedback page.
Subsequent offences will cause 50 Sexybay Points to be removed from the buyer’s account and a reason of “Non-paying
bidder – Subsequent offence” will be published on the feedback page.
If a period of 12 months elapses between non-paying bidder offences, the bidder will be deemed to have 0 non-paying bidder offences
for the purposes of penalties. Previous non-paying bidder offences will remain on record in the feedback system.
Feedback
If a non-paying bidder penalty is enforced, feedback may not be left by either the buyer or the seller.
Black-listing
Sellers have the option of “black-listing” people they do not wish to bid on future auctions. If the seller deems it
appropriate they may add non-paying bidders to their black-list.
Auction Re-listing
If a non-paying bidder dispute is not resolved with the sale of the item the seller can re-list the auction and then, using the form
at http://corporate.sexybay.com.au/enforce/npb/relist.html, they can
request a credit on their account for the re-listing of the item.
Fees
If a non-paying bidder dispute is not resolved with the sale of the item, the seller will automatically receive a credit for all fees
associated with the auction in dispute.
